A source of grievance amongst many of my clients is having to pay maintenance to an ex-wife who either is living with another man or intends to live with another man. Also, when drafting financial agreements there is often a request to include co-habitation as one of the events that will mean maintenance is not payable any more.

Cohabitee rights

There is no such thing as a common-law wife. It is possible to live with someone for many years, have children only to find out when the relationship breaks down that you have no entitlement to any money from your partner. Partners who live together rather than marry do not have the same rights as those who marry. There is, for example, no right to maintenance from a partner in the event of a relationship breakdown although it is possible to claim maintenance for any children.
